LinkTek takes the privacy and security of our customers’ information seriously. Therefore, LinkTek is voluntarily providing this Privacy Statement. By the action of using a LinkTek web site or by providing data to the company, you agree that you understand and agree to this privacy statement and agreement.

LinkTek’s web sites collect only the personal information the visitor elects to provide. LinkTek does not employ “spyware” or similar software that collects personally identifiable information (PII) without your knowledge. Spyware techniques and privacy-invading software from other companies that LinkTek has no knowledge of may occur without our consent or knowledge. LinkTek has no knowledge of nor would LinkTek consent to any such activity by any person or organization. LinkTek does its best to provide quality security measures to protect both you and LinkTek from someone else who may attempt to use a LinkTek site in some fashion that is either untoward or not known to us. To this date, LinkTek knows of no successful attempts by third parties to get data about visitors via the LinkTek web site nor have there been any known, successful attempts to obtain customer data from LinkTek in any illicit fashion. PII collected by LinkTek may include: name, company name, job title, e-mail address, phone number, fax number, operating system, what prompted the visit to the LinkTek web site, purpose of a download, city, state, country, address and what software-related problem the visitor would like help in solving.

LinkTek welcomes user input, feedback, tips, tricks, ideas, success stories and the like. LinkTek makes such information available to users of our web site as FAQs, case studies, tips and other vehicles. Any material or information posted to our web sites or sent to LinkTek in any manner is understood by both LinkTek and the submitting party to be non-confidential and non-proprietary. For example, if there is ever a case where a product is shipped from a location other than LinkTek, then the customer’s contact data will be given to the developer/shipper. In some cases, it may be necessary for LinkTek to share PII with one of our dealers or resellers. Such sharing would be on an individual case-by-case basis and normally, it is the reseller or dealer that obtained most of the given customer data in the first place. It is possible there will be situations where LinkTek may be required or obligated by agreement or statute or otherwise deem it to be in its best interest to provide PII of customers, users or web site visitors to other parties, with or without compensation. LinkTek retains the right to do so at LinkTek’s sole determination. Additionally, customers/users/visitors (you) agree that LinkTek may disclose information containing PII: a) to comply with local, state or federal law; b) to comply with a court order; c) to respond to any complaints that someone’s data or content violates the rights of a third party; d) at the demand of a duly authorized governmental agency; e) to enforce the terms of any agreements between LinkTek and any customer; f) to protect the interests of LinkTek or others; or g) pursuant to a contractual obligation or agreement with another party. All data submitted to LinkTek, regardless of form or content, becomes the property of LinkTek.

LinkTek will use contact data to send visitors/customers information about LinkTek products and services in addition to providing maintenance support and training services. LinkTek complies with the federal law regarding e-mail transmissions and does not engage in any spamming activity whatsoever, per the federal definition of spam. LinkTek provides and complies with the federally-mandated opt-out procedure. LinkTek provides several easy methods for a visitor or customer to ask off any of our mailings, including e-mail and honors all opt-out requests. At the bottom of each marketing e-mail from LinkTek is the exact procedure to be removed from the e-mail list. All LinkTek e-mail messages contain the correct header information; have an accurate subject line; contain a functioning return e-mail address; when applicable, contain a clear indication that the message is a promotion; contain a conspicuous notice of the opportunity to decline further e-mail; contain the physical address of LinkTek and are not sent to any recipient more than ten business days after receiving a request from that individual to be removed from a mailing list
